Terms of use
Provisional version. This text is not yet the final, validated version: passages still to be completed are highlighted. It will be replaced before the app is published.
1. Who is party to what
"Umare" (the "App") is published by [TO FILL IN: publisher's name or company name], [TO FILL IN: address] (the "Publisher"). By installing or using the App, you accept these terms. If you do not accept them, do not use the App.
2. Apple's licence agreement
The App is distributed through Apple's App Store. In addition to these terms, you are bound by Apple's standard Licensed Application End User License Agreement (the "EULA": apple.com/legal/internet-services/itunes/dev/stdeula). That licence agreement is concluded between you and the Publisher only, not with Apple. In case of conflict, the EULA prevails on the points it governs (licence to use, warranties towards Apple, App Store rules); these terms cover the rest. Apple is not responsible for support, maintenance or claims relating to the App, which are the Publisher's responsibility (contact: see § 14).
3. Licence to use
The Publisher grants you a personal, non-exclusive, non-transferable and revocable licence to use the App on Apple devices that you own or control, for private, non-commercial purposes. You may not copy, modify, decompile or extract data or content from the App, nor resell or redistribute it, except to the extent permitted by mandatory law.
4. Optional account
You can play without an account. If you create one (Apple, Google or e-mail address), you agree to:
- provide accurate information and protect your sign-in credentials;
- use one account per person and not transfer your account;
- be at least 15, or have a parent's or legal guardian's permission if you are 13 or 14 [TO CONFIRM: owner's decision]; the App is not intended for children under 13.
The account is used to save your current life and completed lives in the cloud (see the privacy policy). You can delete your account at any time in the App (Settings → Account). Deletion is permanent and does not cancel a current subscription (see § 8). The Publisher may suspend or delete an account in case of abuse (attacking the service, automated access, fraud) or breach of these terms, after a warning where possible.
5. A work of fiction
The characters, families, stories and events are fictional. Birth contexts are inspired by real public statistics (see "Licenses and credits") but neither predict nor judge any real life, person or country; the game greatly simplifies reality (for example, no death before 15). Umare is not a source of information or advice — medical, financial, legal or otherwise.
6. Sensitive content and intended audience
The game deals soberly with themes of life: studies, work, family, money, illness, grief, end of life. It contains no explicit violence, no sexual content and no gambling: in-game money is a fictional resource and the "random" birth is a simple draw with no stake and no real-world prize. Umare is not intended for children under 13. If a theme hits close to home, you can stop at any time; if you are going through a hard time, talk to someone close to you or a health professional.
7. Rules of use
You agree not to: attack, overload or bypass the protections of the service (accounts, save, purchases); use automated means or third-party software to modify the game or to obtain purchase entitlements without paying; attempt to access other people's data; or use the App in a way that is contrary to the law.
8. Purchases, subscriptions and advertising
- Purchases and subscriptions. In-app purchases (the "Destins" extension) and subscriptions (monthly or annual Club) are concluded and paid through Apple's App Store, under its terms (payment, billing, refunds, right of withdrawal). The terms specific to the subscription are on the "Subscription terms" page. [REMOVE AT LAUNCH IF THE OFFER IS NOT YET AVAILABLE: no paid offer is available in the current version.]
- Prices. They are those displayed by the App Store in your currency, including taxes where applicable, before you confirm.
- Restoring. "Restore purchases" (Settings → Store) re-establishes your purchases on another device linked to the same Apple account.
- Advertising. The free version may show ads (see the privacy policy). Club subscribers see none [TO CONFIRM: and people who bought the extension?].
9. Your games
They are saved on your device. Without an account, the Publisher can neither recover nor transfer them; uninstalling the App or changing device may erase them. With an account, they are also saved in the cloud, with no guarantee of continuous availability.
10. Intellectual property and third-party components
The App, its pixel art, texts, sounds and code belong to the Publisher or its licensors, subject to the licences of third-party components (SIL OFL fonts, World Bank CC BY 4.0 data, Natural Earth, open-source libraries), detailed on the "Licenses and credits" page and in the App (Settings → Open-source licenses). The UMARE name and logo are the Publisher's property [TO CONFIRM: not a registered trademark at this time]. The card you share is content you create and share under your own responsibility; it contains fictional elements of the App that you may show for personal purposes.
11. Availability and evolution of the service
The App is provided "as is", with no guarantee of being error-free or uninterrupted, to the extent permitted by law. The Publisher may change the App, its content and the online features (account, save), and suspend or stop them; if it ends a current subscription, it will tell you and refund the unused part of the paid period [TO CONFIRM].
12. Warranties and liability
Your consumer rights are not affected, including the legal guarantee of conformity applicable to digital content and services (for French consumers, articles L. 224-25-1 et seq. of the Consumer Code) [TO BE REVIEWED: references]. To the extent permitted by law, the Publisher's liability is limited to direct and foreseeable damage; it is not limited in case of gross negligence or wilful misconduct, personal injury, or any liability that cannot be excluded by law.
13. Term, termination, changes
You can stop using the App at any time by uninstalling it (and deleting your account if you have one). The Publisher may change these terms (changes to the service or the law); the update date is at the top of the page and you will be informed of any important change before it applies; continuing to use the App after that date means acceptance.
14. Contact, mediation, governing law
- Contact and complaints: [email protected] (see the "Support and contact" page).
- Consumer mediation: for an unresolved dispute, you can use [TO FILL IN: consumer mediator] free of charge [TO CONFIRM: mandatory for a professional who contracts with consumers].
- Governing law: French law applies, without depriving consumers of the protection granted by the mandatory rules of their country of residence. For consumers in the European Union, the competent courts are those provided by law, including those of your place of residence.
